Asaram Bapu, who is serving a life sentence for imitating the spiritual leader, was granted provisional bail on January 7, 2025, by the Supreme Court of India.
He has recently requested respite because his health is getting worse. He is an accused person in a Gujarati court.
A Bench of Justices M.M. Sundaresh and Rajesh Bindal listened. The court has imposed strict conditions on his bail, barring Asram from meeting his followers. He will continue to look after her even after her temporary release from Jodhpur jail, where she is also serving a separate sentence in another rape case.
Courtroom Arguments
Senior Advocate Devadatt Kamat, along with Advocates Rajesh Gulab Inamdar and Shashwat Anand, represented Asaram Bapu. They highlighted two main points:
Health Concerns: Advocates argued that Asaram’s advanced age, cardiac ailments, and other severe medical conditions required urgent treatment outside the prison. It was argued that continued imprisonment could endanger his life.
Weakness in evidence: The defense argued that the case against Asaram was largely based on the victim’s uncorroborated testimony. There were contradictions in the story.
The court did not address these issues but focused only on Asaram’s health needs.
Court’s Ruling
After scrutinizing the pleadings, the Supreme Court has allowed interim bail with the observation that it is solely on compassionate grounds. It clarified that the relief is only temporary and strictly conditioned. The court further ordered that Asaram’s health shall be reassessed nearer to the expiry of the bail period to decide on further steps in the matter.
Background of Conviction
A Gujarat state court convicted Asaram Bapu of raping an unidentified female disciple at his Gujarat ashram on January 31, 2023. laws 376, 376(2)(h), 377, and 506 of the Indian Penal Code were among the several laws for which he was found guilty.
Section 376: Rape
Section 377: Unnatural offenses
Section 342: Wrongful confinement
Section 506: Criminal intimidation
Section 354: Assault or criminal force to outrage modesty
The result was a life imprisonment sentence.
Notice has been issued by the Supreme Court bench of Justices Sundresh and Aravind Kumar to the Gujarat Government concerning Asaram’s petition seeking suspension of his sentence in November 2024. Comparison of Humanitarian with Legal Aspects Asaram’s interim bail has again led to a much-required disquisition on the balance that has to be drawn between legal accountability and humanitarian relief. While some see it as sympathy for an aging convict suffering from poor health, many still are debating the very concept of granting such relief in case of serious crimes.
As has been the trend now, Asaram’s case continues to remain the battle zone for arguments over the effective intervention mechanisms of the higher judiciary vis-a-vis the dispensing of justice keeping humanitarian considerations in mind.
